Mediation
Fee Schedule
Mediation fees are charged on
the basis of a fixed fee per party for each day of mediation. A
mediation day usually begins at 9:00 a.m. and ends around 5:00 p.m.,
and includes a working lunch. Where mediations extend into the evening,
no additional charge is imposed. If a mediation takes more than
one day, a second daily fee is charged, but second day mediation
occur only upon the concurrence of all concerned (unless expressly
ordered by the Court).
The mediation fee is based upon: (1) the amount in controversy,
(2) the number of parties, and (3) the experience level of the
mediator. The "amount" includes the total of all claims
(including counterclaims and attorney's fees) but does not include
court costs or exemplary damages. All parties represented by the
same attorney or law firm are considered one party for purposes
of the mediation fee. The usual mediation fee each party pays
is as follows (if higher rates apply to a particular mediator,
advance approval will be obtained):

Fees for mediations involving more than four parties are arranged
on a case-by-case basis, but generally within the foregoing guidelines.
Fixed Time Mediation Fixed time mediation is
available for half-day (four hour) sessions. Each party is charged
*$550 where the amount in controversy is less than $500,000, and
$650 where the amount in controversy exceeds $500,000. The mediation
terminates at the end of the four hours, whether or not resolution
has been achieved. [*This fee is reduced to $450 per party for
cases where the Amount in Controversy is under $5,000]
High/Low Arbitrations The charge for high/low
arbitrations is $450/party for a two hour arbitration & $650/party
for a four hour arbitration regardless of the amount in controversy.

Cancellation & Continuance Policy If either
party fails to appear on the day of the mediation and that party
has not provided adequate notice of same within a reasonable period
of time (usually 3 workdays) the party that fails to appear will
be charged for the scheduled hearing time. If prior to that time
the case is rescheduled to a later date, by agreement of the parties
and the mediator, the current fee for the case will be applied
to the rescheduled mediation. The mediator will generally consent
to the rescheduling of a case when the request is made with reasonable
notice.
Our objective is to provide quality mediations at affordable
prices. If the foregoing fee schedule and policy is inappropriate
in a given case, further accommodations can be made.
